By accessing or using the Site, you confirm that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Site. The Site is intended for individuals aged 16 or older. If you are under 16, you may use the Site only with the involvement and supervision of a parent or legal guardian.

These Terms incorporate our Privacy Policy and Cookie Policy by reference. Those policies explain how we handle personal data and cookies.

2. Important Disclaimers (Tattooing and Piercing)

The Site provides general information about studio services such as custom tattoos, safe piercing, and custom art. It is not medical advice. Individual outcomes and healing timelines vary based on placement, skin condition, aftercare, lifestyle factors, and other variables.

• All services are performed by professional artists using a studio workflow designed for hygiene and safety.
• We follow a sterile, single-use approach for needles and use barrier protection during procedures.
• You are responsible for your design choices and placement decisions, and for following aftercare guidance provided after your appointment.
• If you have health concerns, allergies, or contraindications, you should consult an appropriate medical professional before booking.

We do not promise or guarantee specific results, healing outcomes, or aesthetic satisfaction. Any examples, descriptions, or guidance on the Site are informational and should not be interpreted as a guarantee.

3. Description of the Site and Our Services

The Site is a lead and information channel for Nexalyx Tattoo Studio. It allows you to review our services and submit requests for consultations or bookings. We may update, change, suspend, or discontinue any part of the Site at any time without notice, including page content, service descriptions, and availability notes.

Submission of a form does not create a confirmed appointment. A booking is confirmed only after we respond and explicitly confirm availability and any required next steps. We may ask for clarification about placement, size, style, reference, or timing to prepare an accurate plan.

4. Acceptable Use

You agree not to misuse the Site. In particular, you must not (and must not attempt to):

• Access or use the Site in any way that violates applicable law or regulation.

To the maximum extent permitted by law, Nexalyx Tattoo Studio LLC disclaims all warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components, or that any content will be current or complete.

8. Limitation of Liability

To the maximum extent permitted by law, Nexalyx Tattoo Studio LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, loss of revenue, loss of data, or business interruption arising out of or related to your use of (or inability to use) the Site.

To the maximum extent permitted by law, our total liability for any claim arising out of or related to the Site will be limited to the greater of: (a) the amount you paid to us in the 12 months preceding the event giving rise to the claim (if any), or (b) £100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

9. Indemnification

You agree to indemnify and hold harmless Nexalyx Tattoo Studio LLC from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Site, (b) your violation of these Terms, or (c) your submission of false, unlawful, or infringing content through the Site.

10. Force Majeure

We will not be responsible for any delay or failure to perform resulting from causes outside our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, pandemics, labor disputes, internet or telecom outages, cyberattacks, or third-party cloud or hosting failures.

11. International Use

The Site is operated from the United Kingdom. We make no representation that the Site is appropriate or legally available in all jurisdictions. If you access the Site from outside the United Kingdom, you are responsible for compliance with local laws.

12. Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of laws principles. The courts of London, England will have exclusive jurisdiction over any dispute arising out of or related to these Terms or the Site, except where mandatory consumer protection rules provide otherwise. Consumers in the European Economic Area may also have the right to bring proceedings in their country of residence.

If informal resolution is not successful, either party may pursue a claim in the courts as described in Section 12.

The following sections survive termination: Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and any other provisions that by their nature should survive.

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Nexalyx Tattoo Studio LLC regarding your use of the Site and supersede any prior or contemporaneous agreements or communications.

17. Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, asset sale, or corporate reorganization.

18. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing to be effective.
